This website provides free home improvement estimates and connects homeowners with Cali First Remodel, Inc. (a licensed California contractor, CSLB Lic. #1105991) and other licensed home improvement professionals. It allows homeowners to submit requests for free estimates on projects such as kitchen remodeling and bathroom renovation.

Through our website and multi-step estimate funnel, we provide the following services:

• Collection and processing of project inquiry information submitted by homeowners.
• Matching of homeowner inquiries with licensed and qualified home improvement contractors in our professional network.
• Delivery of personalized estimate offers based on user-provided project preferences and priorities.
• Facilitation of initial contact between homeowners and contractors for the purpose of obtaining home improvement quotes.

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice.

3Lead Generation Disclaimer

By submitting an inquiry through our website, you understand and agree to the following:

• Your inquiry information will be shared with one or more licensed contractors in our network who may contact you to discuss your project and provide a formal estimate.
• Any estimate provided through our website is preliminary and non-binding. Final pricing and project scope are determined through direct agreement between you and the contractor you select.
• CaliFirst Remodel does not guarantee the availability, pricing, timeline, or quality of any contractor in our network.
• Any contract for home improvement services is solely between you and the contractor you choose. CaliFirst Remodel is not a party to such contracts and assumes no liability under them.
• You are under no obligation to hire any contractor introduced through our platform.

4TCPA Consent & Electronic Communications

You may revoke your consent to receive automated calls or text messages at any time by:

• Replying STOP to any SMS message you receive from us or our contractor partners.
• Submitting a request through our Privacy Choices page, clearly identifying the phone number to be removed.

Revocation of consent is effective within a commercially reasonable time after receipt. Revoking consent does not affect the lawfulness of any communications made prior to the revocation, and it does not affect your right to receive a free estimate or any services already in progress.

By using this website, you also consent to receive communications from us via email at the address you provide, including estimate information, project-related communications, and service updates. You may opt out of email communications by following the unsubscribe instructions in any email we send.

5User Representations & Eligibility

By using our website and submitting information through our forms, you represent and warrant that:

• You are at least 18 years of age and have the legal capacity to enter into a binding agreement.
• All information you provide is accurate, current, and complete to the best of your knowledge.
• The phone number and email address you provide belong to you, or you have express authorization from the subscriber or owner of those contact details to submit them and consent to communications on their behalf.
• You are the legal owner or authorized occupant of the property for which you are requesting an estimate, or you have authority to request home improvement services for that property.
• Your use of our website does not violate any applicable law or regulation.

6Prohibited Conduct

You agree not to use our website or services for any of the following purposes:

• Submitting false, misleading, or fraudulent information in any form.
• Submitting contact information belonging to another person without their express consent.
• Using automated scripts, bots, or other automated means to access, scrape, or submit information to our website.
• Attempting to gain unauthorized access to any portion of our website, servers, or databases.
• Interfering with the proper functioning of our website or the experience of other users.
• Violating any applicable local, state, federal, or international law or regulation.
• Submitting multiple inquiries for the same project for purposes of disrupting our matching process or misusing contractor resources.

We reserve the right to refuse service, terminate access, or remove submissions that we determine, in our sole discretion, violate these Terms or are otherwise harmful to our platform, users, or contractor partners.

7Intellectual Property

All content on this website, including but not limited to text, graphics, logos, images, design elements, and software, is the property of CaliFirst Remodel or its content licensors and is protected by applicable United States and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use our website for personal, non-commercial purposes only. This license does not include the right to reproduce, distribute, modify, publicly display, create derivative works from, or commercially exploit any content on our website without our prior written consent.

8Disclaimer of Warranties

We do not warrant that our website will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any content, estimates, or information provided through our website or services. Estimates provided through our platform are preliminary only and do not constitute binding offers or commitments by any contractor.

9Limitation of Liability

To the fullest extent permitted by applicable law, CaliFirst Remodel and its officers, directors, employees, agents, licensors, and service providers shall not be liable to you or any third party for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, loss of data, loss of goodwill, service interruption, computer damage, or system failure, arising out of or in connection with your use of our website or services, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages.

Our total cumulative liability to you for any claims arising out of or related to these Terms or our services shall not exceed one hundred dollars ($100.00) or the amount paid by you to us in the preceding twelve months, whichever is greater. Some jurisdictions do not allow the exclusion or limitation of certain damages, so these limitations may not apply to you.

11Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods shall not apply to these Terms. You consent to the exclusive personal jurisdiction of the state and federal courts located in Los Angeles County, California for any dispute arising under or related to these Terms that is not subject to arbitration.

12Dispute Resolution & Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms, the breach thereof, or your use of our website or services (“Dispute”) shall be resolved through binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, except as provided below. The arbitration shall be conducted in Los Angeles County, California, unless both parties mutually agree to a different location or a virtual proceeding.

Class Action Waiver: You and CaliFirst Remodel each waive any right to bring or participate in a class action, class-wide arbitration, or any other collective or representative proceeding. All disputes must be brought in your individual capacity only.

Exceptions: Either party may seek relief in small claims court for disputes within that court’s jurisdiction. Either party may also seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights or to address unauthorized access to or use of our website.

Opt-Out: You may opt out of this arbitration agreement by submitting written notice through our website contact form within 30 days of first accepting these Terms. Your opt-out notice must include your name, the email address used to submit your inquiry, and a statement that you wish to opt out of arbitration.

13Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the “Last Updated” date at the top of this page. Your continued use of our website or services after any changes take effect constitutes your acceptance of the revised Terms.
